舒梅律师

         舒梅律师，北京市鼎鉴律师事务所副主任、创始合伙人,北京律师协会国际投资与贸易专业委员会秘书长，北京市朝阳区大屯街道人民调解委员会专家调解员，北京大学法律硕士。舒梅律师在攻读北京大学法律硕士学位期间所撰写的硕士毕业论文《论版权作品独创性标准的认定与适用》受到北京大学和中国政法大学多名教授的一致好评。
        舒梅律师擅长国际投资和贸易、涉外仲裁，以及版权、商标等知识产权法律专业领域。她曾担任联合国全球生态文明论坛基地、2010年第29届世界音乐教育大会、中国教育网络电视台书画台，以及中国移动通信集团设计院有限公司等知名机构和企业的法律顾问。她曾代理中国末代皇帝爱新觉罗.溥仪之亲弟溥任等名人案件。舒梅律师还创办并主持《在线律师》网站的《国际贸易律师》、《著作权》等专栏，以及“鼎鉴律所”网站的《国际贸易与ODR》、《版权律师》专栏，累计办理各类案件数以千计，有些案件在国内外产生较大影响。
       舒梅律师的有关成功职业经历、业绩入选2007年《中国法律年鉴》“中国法律专家档案”。因在涉外法律事务领域所取得的成功业绩，舒梅律师被中华全国律师协会主编的《中国律师年鉴》选为优秀涉外律师，被CCH和法律出版社合作出版的《中国涉外律师》评为专家律师。舒梅律师主办的XXX诉甘肃人民出版社、《读者》杂志社主编、广东XXX公司等五被告主编署名权案作为优秀案例荣登《法制日报》的《中国律师风云榜》。
       舒梅律师代理的著作权案件类型丰富，成功率高，反响较大，包括但不限于教材著作权、剧本著作权、音乐著作权、网络著作权、软件著作权、医学论文著作权、图片著作权，以及律师事务所网站等著作权被侵权案。此外，舒梅律师还曾代理XXX公司应对九阳豆浆集团提起的商标权侵权之诉并大获全胜。
       在舒梅律师代理北京XXX公司就其所属的某大型B 2 B商务网站被侵权一案起诉上海某公司和温某的案件中，二审终审判决二被告对原告网站的软件源代码构成实质性和根本性侵害。侵害的主观恶性大，客观上对原告造成了极其严重的损害和不利影响。法院判决要求被告立即停止使用该网站的软件源程序，并在侵权网站首页连续24小时向原告公开赔礼道歉。但遗憾的是，原告最终仅获赔5万元，尚不及原告为此案付出的精力、成本和费用。原告虽胜诉，但被告侵权代价之低，原告维权成本之高却让舒梅律师心情沉重，思考颇多。对于知识产权案件赔偿数额的确定，即法官应如何正确行使自由裁量权以最大程度地保护著作权人的权利并激发其创造性，同时有效遏制侵权行为的发生，这是法律人共同面对并亟待解决的问题。
       习总书记在2014年10月15日召开的文艺工作座谈会上指出，文艺工作者应该牢记，创作是自己的中心任务。一部好的作品，应该是把社会效益放在首位，同时也应该是社会效益和经济效益相统一的作品。文艺不能当市场的奴隶，不要沾满了铜臭气。优秀的文艺作品，最好是既能在思想上、艺术上取得成功，又能在市场上受到欢迎。
       习总书记提出了在文化大发展的当今中国，社会效益和经济效益，物质世界和精神世界如何统一并和谐发展，及其本末和主次等根本性问题。这些问题不但存在于书画市场，而且是当今文化艺术领域普遍面临并亟待解决的关键性问题。只有这些问题得到切实可行的解决，知识才能真正受到尊重，“创作”、“创造”、“独创性”这些充分体现个人思想的词汇才真正具有份量和价值。
       知识就是力量，是生产力发展的重要源泉和动力。只有当知识得到充分且有效保护，阻碍并制约中国经济和文化共同大发展的关键问题才能迎刃而解。保护版权、商标、专利以及非专利技术等知识产权即践行依法治国，是经济和文化共同大发展的根本前提和保障。

Attorney Shu Mei is the Deputy Director and the co-founder of Beijing TopBest Law Office, a member of the All China Lawyers Association, a member and Secretary-general of the Professional Committee on International Investment and Trade of the Beijing Bar Association.  She holds a Master Degree in Law from Peking

University.
Attorney Shu started practicing law in 2000, and has expertise in international trade, real estate, copyright and corporate affairs, etc. She has handled cases for the UN Global Ecological Civilization Forum, the Organizing Committee of the 29th ISME World Conference in 2010, Beijing P&T Consulting & Design Institute Co., Ltd., and Aixinjueluo Furen, the younger brother of China’s last emperor Aixinjueluo Fuyi. China Foreign Lawyer co-published by CCH and the Law Press, and the 2009 Attorney Yearbook of China  selected Attorney Shu as a successful and excellent attorney in foreign legal affairs.

Attorney Shu has been interviewed by Outlook Weekly of the Xinhua News Agency, CCTV, Beijing TV, The Legal Daily, China Trade News, The Beijing Youth Daily, China Consumer Journal, The First and Beijing Music Weekly.  She published several important articles including Chinese Lawyers Face the Challenge of WTO and Ordinary people have Difficulties in Lawsuits.
Attorney Shu not only has gained foothold in China but also is building bridges around the world. In October, 2008, upon the invitation of the America Bar Association (ABA), Attorney Shu visited the U.S.A. to meet the senior administration officers of the ABA and some senior partners of American big law firms.  Attorney Shu discussed with them about some important issues, such as the protection of  Intellectual Property Rights and the establishment of Lawyer System. As a result, Attorney Shu has built up a friendly relationship with the American law firms.
