本所本所高级顾问、南昌大学教授方旭辉(Michael Fang)在核心期刊河北法学第32卷第7期(2014年7月)发表了题为“探析不方便法院原则在韩亚航班空难案的适用”的文章,(全文共1 7,8 1 3 字),作者于2014年1月在美国与受理韩亚空难案的美国瑞贝克律师事务所(Ribbeck Law Chartered International)的律师讨论了韩亚空难案,但本文只是作者观点,不代表律师事务所观点。中英文摘要如下:
“蒙特利尔公约”有关管辖权的规定使许多韩亚空难受害者不具备在事发地对韩亚航空公司起诉的资格。但是,受害者可以避开该公约,在美国起诉飞机制造商———波音。波音则可以用不方便法院原则为由要求法院驳回诉讼,并强调美国最高法院在派珀飞机公司诉雷诺一案中指出美国法院对外国原告的法院选择应予以较少的尊重。对此,韩亚空难受害者可以在伊利诺伊州库克县巡回法院起诉波音,因为在一系国际空难案件中,该州法院拒绝了波音以不方便法院原则为由驳回外国原告起诉的请求。然而,伊利诺伊州高级法院于2 0 1 2 年对A rik v. B oein g C o. 一案的判决是不可忽略的,它适用了不方便法院原则。尽管如此,该案例与韩亚空难案有实质性的区别,因此,该州法院不会依据不方便法院原则而拒绝诉讼。
According to the jurisdictional provisions of the Montreal Convention (formally, the Convention for the Unification of Certain Rules for International Carriage by Air), many victims of Asiana Airlines flight 214 crash do not qualify to sue Asiana in the United States. However, the victims can bring lawsuits against the plane’s manufacturer, Boeing Co. in its headquarter, Illinois without applying the Convention. On the other hand, Boeing could defend itself by moving to dismiss on forum non conveniens(FNCs) grounds , arguing that many courts follow the general rule of FNCs refined by the U.S. Supreme Court in Piper Aircraft Co. v. Reyno, which held that“a foreign plaintiff's choice deserves less deference.”Nevertheless, the State of Illinois Circuit Court of Cook County provides exceptions to the “general rule”of FNCs by resisting the hostility to foreign plaintiffs' choice of forum. It denied FNCs motion filed by Boeing and other defendants when deciding product liability and negligence cases arising out of a series of international aviation accidents. Therefore, Asiana Air crash victims can choose the the Illinois state court in Cook County as an adequate forum to bring suits again Boeing. Although, the Supreme Court of Illinois in Arik v. Boeing Co. ruled that the lower courts should not have denied defendants’ motion to dismiss based on the doctrine of forum non conveniens, the case decided by the Illinois Supreme Court is distinguished from Asiana Airlines Flight 214 Crash case.
此外,方旭辉早在韩亚航空空难发生后的1个月,就在北京市律师协会作关于网上争议解决机制(ODR)的报告时指出,ODR影响到法律领域的方方面面,包括对不方便法院原则取证的影响,并举例(案例)说明。
